This Participant Release ("Release") governs your participation in the Glamour magazine online reader panel (the "Panel") organized by The Conde Nast Publications and Smartwater ("Sponsor"), whereby you agree to test certain product(s) ("Product") provided by Smartwater ( "Product Provider") and send us your feedback.

Please read this Release carefully. By clicking "I Agree" below and/or by participating in the Panel, you agree with all terms and conditions set forth herein. In addition to reviewing this Release, please read our User Agreement and Privacy Policy. Your agreement to this Release also constitutes agreement to the terms and conditions of these documents. In the event of any ambiguity, inconsistency or conflict between this Release and the User Agreement or Privacy Policy, the terms and conditions of this Release shall control and prevail.

If you do not agree with the terms of this Release, the User Agreement, and/or the Privacy Policy, please click "Disagree" below, exit the Website and do not participate in the Panel.

Your failure to follow Sponsor's rules, whether listed herein or in supplemental notices communicated through the Panel, may result in termination of your access to and participation in the Panel, without notice, in addition to Sponsor's other remedies.

You represent that you are at least 18 years of age and a legal U.S. resident living in the contiguous United States. You agree to submit all information required by the deadline(s) of Sponsor. You understand that there is no guarantee Sponsor will choose you to participate in the Panel.

You may be required to provide Sponsor with certain registration information. You agree and represent that all registration information provided by you is accurate and up to date. If any of your registration information changes, you must update it by sending us an email to glamspotters@glamoursurveys.com.

You represent that you do not work for a company competitive with Product Provider in the consumer products field. ("Competitive Company").

You acknowledge and agree that any information or materials set forth herein or through the Panel are intended for general informational purposes, and should not be construed as medical advice, medical opinion, diagnosis or treatment. Such Products are not a substitute for medical attention; you should see your health care professional for medical advice and treatment. You acknowledge and agree that the Products are for your sole use and may not be distributed or shared with a Competitive Company or on the general market for such Products.

You acknowledge and agree that you will not share the details (including but not restricted to photos, description, name, ingredients)of the Product with any Competitive Company, or publish or comment on the details of the Product in any printed materials or on any personal or other website, or elsewhere until at least February 2009.

You hereby release and hold harmless Sponsor and the Product Provider, their parent, subsidiary, affiliated entities, and each of their respective officers, directors, members, employees, licensees, consultants, independent contractors, representatives, agents, successors and assigns (the "Releasees") of and from any and all liability, claims, demands, actions, and causes of action whatsoever, arising out of, in connection with the Panel, or related to any loss, damage, or injury, including death, that may be sustained by you or your property arising from use of the Product, including claims that are known and unknown, foreseen and unforeseen, future or contingent, or that arise out of the negligence of Sponsor or Product Provider or otherwise.

Being fully aware of the risks inherent in participating in the Panel and using the Product, you hereby elect voluntarily to engage in such activities. You hereby voluntarily assume all risk of loss, damage, or injury, including death, that may be sustained by you, or any of your property in connection with such activity.

You also acknowledge that the Sponsor and Product Provider may publish names and quotes from Panel participants in advertising, promotional and marketing material ("Ad Copy"). You hereby irrevocably grant, release and quitclaim to Releasees and others they may authorize the right to use your name, photograph, likeness, quotes and information about you in connection with such Ad Copy in any and all media now in existence or hereafter developed without limitation, liability or further compensation to you.

In agreeing to this Release, you hereby acknowledge and represent that you have read and fully understand it. You understand that this is a release of liability which will legally prevent you or any other person from filing suit or making any other legal claim against Releasees relating to the causes of actions or claims hereby waived or released by you. You nevertheless enter into this agreement freely and voluntarily and agree that it is binding upon you, and your heirs, assigns and legal representatives.

Panel entries that are lost, late, misdirected, garbled, or incompletely received, for any reason, including by reason of hardware, software, browser, or network failure, malfunction, congestion, or incompatibility at Sponsor's servers or elsewhere, will not be eligible. Sponsor and Product Provider, in their sole discretion, reserve the right to disqualify any person tampering with the entry process, the operation of the Panel or Website, or otherwise in violation of this Release or other rules. Sponsors further reserve the right to cancel, terminate or modify the Panel or any promotion not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause(s) beyond Sponsor's control.

In the event of a dispute as to the identity or eligibility of any participant based on an e-mail address, the actual participant will be declared to be the Authorized Account Holder of the e-mail address submitted at the time of entry, unless determined otherwise by Sponsor in its sole discretion. "Authorized Account Holder" is defined as the natural person, 18 years of age or older, who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, education institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Multiple entries and use of automated devices are not valid for entry or participation in the Panel.
